I wouldn't recommend to keep using it, not only could electrical charges like that make you get your data corrupted on the hard drive, and otherwise kill the system itself, but it can be a health risk.

Whistling? Or you mean more like a whine? If it comes from the laptop, it's a fairly common problem that's considered to be harmess. It can get annoying, but that's about it. If it does in fact come from the power brick itself.. then that's pretty weird. o_o

EDIT: Also, I agree with Osayidan. It's hard to predict what can happen with electrical faults like these. My netbook shocked me twice, but it was probably static.. and the webcam died after that. It also gives me annoying USB popup errors. :<
IMO, you should at least attempt to escalate the matter and see if they budge from their position on the repair. BBB and CPSC gogogo!
