Return it for a refund, claim it was dead/defective on arrival. Easier than dealing with a manufacturer warranty. Might wanna wipe your files off of it with a secure erase tool.

I'd go for the software solution if you can. There are free tools out there.

Programs like Eraser, which is found in here:
http://sourceforge.net/projects/eraser/, does a good job at erasing harddrives.

Go to Western Digital's website and get an Advanced RMA. They'll mail you a new harddrive first, then after you use something like Acronis TrueImage and clone your broken hdd to the new one, you can mail them the broken one after you delete all your data on it with a destruction algorithm.
They'll need a credit card and charge the cost of the hdd, but as soon as they get the broken one back they refund it to your card. So it's basically free except the cost to ship it to them. They ship it to you for free.

Keep in mind there's also a hard drive shortage due to the floods in thailand.
We're selling hard drives at 60% more than normal and clients jump at them like if they were gold.
So it's possible a replacement will take long, or you might get back an already-repaired one.
