Hours late but whatever.
U.S. District Judge Vaughn Walker has ruled that California’s Proposition 8, the ban on same-sex marriage, violates the U.S. Constitution. The ruling was released on Wednesday afternoon at approximately 1:40 p.m.
The voter-approved measure, which passed in 2008, defines marriage as a union between a man and a woman.
Judge Walker also approved a temporary stay blocking same-sex couples from marrying. Couples attempting to wed at San Francisco's City Hall were denied marriage licenses Wednesday afternoon.
Check our website throughout the afternoon and evening as we offer ongoing coverage of reactions to the Prop. 8 decision.
Quote from Walker:
Moral disapproval alone is an improper basis on which to deny rights to gay men and lesbians.

Even though same-sex marriage is temp. banned, this is still great.
Even better, this judge was nominated by Ronald Reagan.

So...they ruled it was unconstitutional for some reason other than actually blocking marriages?
People are celebrating a lot, but I don't think they've necessarily done anything yet seeing as how there's still a ban.

Banning same sex marriage and blocking it instead? Let's celebrate!
/sarcasm
I guess it's a step towards the right direction, though.

The problem is ... it will be appealed to the Supreme Court, and its doubtful that the current (5/4 republican) justices will rule against the gay marriage ban.
Unless the ruling is a Supreme Court ruling, it pretty much doesn't count.

Judge Walker agreed, saying that Proposition 8 imposed on the constitutional rights of gays and lesbians to marry partners of their choice, rights that are protected under Due Process and Equal Protection Clauses of the Fourteenth Amendment.
This decision can probably be used in further arguments.
Even though gay marriage is still banned it's only because the Judge
issued a temporary stay until he decides whether to suspend his ruling while it is being appealed.

It shouldn't be banned
because gay couples wouldn't get the same tax benefits as married straight couples

Religion is the main reason it was ever banned...

Not religion, over zealous religious people who don't realize that they can't make laws based on their personal beliefs.
The irony is that at least one religion is very clear about that, but people are more interested in using it to gather support than actually adhering to what it teaches.

Without religion there would not be overzealous religious people.
But yeah, that's basically what I meant.

Yeah, I can't argue with that~
Just that when you're so general about it, the rest of us get lumped in with them. And believe me, it's no fun trying to unravel some untold amount of misinformation that fuels a prejudice against you.

Without religion there wouldn't be marriage either. Too many people forget that marriage is a religious thing, which is why I disaprove of all marriage be they gay, straight, or anything else people can come up with.

I am so, so happy for my fellow gay friends over in California right now!
If I hadn't quit drinking, I'd pop a bottle and celebrate right now!
YES!

Incorrect. Marriage may have begun as a religious ceremony, however it isn't entirely religious these days.
Civil marriages for example. Getting married at City Hall, etc., etc.
I don't disprove of marriage. It goes beyond religion. It's about love.
