  Where I believe the line stands is in these situations:

  
  
  • If you're selling food in the same state you bought it or if the food aged, you don't need a temporary license. If they get sick from buying aged food, it's on their fault if they know it's aged.
    
  • If you're selling food at your front lawn, you don't need a temporary license unless someone gets a moderate illness from your food. (Like being sick for a week can tell for a non-mild infection)
    
  • If you're selling food at a public event and you do not need a temporary license.

  1. California and Texas sure are big states; shipping food can take a while. What if the customers don't know if the food is aged past edibility?

  My opinion on the matter, unless you meant that the actions taken to rectify those situations should follow according to the law.

  1. Compare a rotten tomato to a perfectly fine tomato. Old food gives off a smell where bacteria and fungi thrive. Sometimes when you touch the food you can feel if it's good or not.
  
  2. Do we have to get a group of students at school to have a temporary license if they want to sell food to their own students during such events like a fundraiser? For charity? For money to fund their club? You are still selling food to a general public.

  3. If you're food at a restaurant, you obviously have a license to sell food since the food agency checks on you. It doesn't matter if you sell food at a public event unless it's new food. If you're a little girl or a small group selling lemonade/food, I think all the health inspector needs to do is to see ask or see how the girl/group makes the food and to check what's in the food.

  1. Rotten or unclean foods are not always easily identified, especially if covered in a multitude of delicious sauce.
  
  2. Since the students are selling their wares in school confines, they have to get the permission of the school, which will probably be held accountable if something happens. The license is required for accountability, so the city can easily track down the licensed establishment if something bad happens.
  
  3. Whatever that means. Perhaps you could clarify?
