New York Judge rules 6-year-old can be sued

That's why they should ask. They're suing for her death, not the hip. No proof the hip injury caused death means they can't win.

I wonder if that means they got the autopsy back and it did hold something conclusive then? Otherwise they might as well have dropped the case. That might be why it took so so long.

She was 87 years old! If they wanted the girl or her family to pay for anything they would have to prove irrefutably that it was the girl who caused the death. All the girl's family needs to do is show that if could have possibly been complications in the hospital due to age, poor health, or any other factor. With the old woman being 87, that possibly would be very very easy to pull off.

The best I can see the other family doing is proving that the girl caused the hip injury and have expenses paid for only the procedures that pertained to mending the hip.

Which is why the girl is getting sued, as the only thing the family thinking right now is that the little ***** ran their family member over, and now not only are they stuck with a huge medical bill, and funeral bills, they are stuck with grief and anger. And just the thought that she and her family gets away with it is what burns them in even more anger.
That would be the same as having some one in your family having a weak condition and getting killed from the act of a child. So what you think your just going to say that no it is a child could have been from their weak condition as an excuse, when it is complete bull ****? No you are going to sue the pants off the family or child for your ease of mine and to have justice.

If they were going down a steep hill, I can't really see how it would be their responsibility.

Then again, I can't see how it's either party's responsibility either way.

It was just an accident..

An accident that contributes to death is still a form of murder, like how a company could be sued for cancer-related deaths of the people that used its products if they were deemed to have caused cancer in those people.

That being said, the only reasonable charge that could be filed against the kids and their parents are for the medical expenses needed for the hip surgery if the impact from the bikes was found to be the direct cause of the fractured hip. It doesn't seem likely that those kids were the main reason for the fractured hip, but unfortunately, I haven't been able to get much information on this case.

Some one can still be sued, and you would get jail time,or in this case the child is getting sued.

It could also be ruled as 3rd degree murder, due to recklessness. But manslaughter is more likely.

Hmm..

Oh yeah, I read up on this some more and apparently the two kids were racing and their parents were nearby. They hit the woman on the sidewalk, I think.
