Grandma has to get surgery on her hips (which has a lot of vessels and sever damage to your hips is from what I heard a nightmare to patch up)
Grandma dies 3 months later.
Little girl cause grandma to need surgery, didn't work out, grandma died, little girl fault.

I'm not sure you know what you're talking about.
Hips don't have a lot of vessels, and the difficulty of the 'patching up' of the hip relates to the kind of injury. And even then, the same type of injury can either be very easy, or highly difficult depending on the individual case.

Mmmm.... regardless of what the judges ruled here, it's very unlikely the family of the grandma will win the case anyways.
The only reason they sued the girl is because they cannot sue anyone else, especially the parents since they, I presume, are not involved in the accident anyways... so if they want to get compensation from somewhere for the grandma's death, it would sadly be suing the girl since if they sued someone else, their case would not stand in court.
Now the little girl isn't at fault here, the surgery could have been unsuccessful because the surgeons the grandma went to may have no tried their best, so that would mean it isn't the girl's fault for the death... And even if they did try their best in surgery, to my knowledge there has been no cases in America where a child had been sued successfully for injuring others.
Idk... the judges better make the right decision....

It could be accidental or not, the fact that it was a factor in death means it doesn't matter if it with the intent of the girl or not.

This ruling only stated that the girl could be sued. The law in question says a child under the age of 4 cannot be found negligent. The girl, who was nearly 5 at the time, was determined not to fall under this law, and could be found negligent. In order to find her negligent, it has to be shown that she acted without the diligence of a typical 4 (almost 5) year old. A tough case indeed.

Good point was thinking of the entire bone region and not just the hip.
But my logic is sound. That is the exact same reason for any accident, get hit by a car, surgery fails, person dies, driver gets hit with a vehicular manslaughter. Either way the family is going to get sued.

Shes 87 she had a heart attack. She was probably 88 when it happened.
