I don't get who's bright idea it is to write the ToSs that way, and expect everyday people to actually read it (they don't) and understand it (most don't)

Well that's what an education is for..
(Then again.. perhaps as we get older, we simply don't try much to understand the terms)
However, the reason ToSs are written that way are those people who try to look for loopholes, things to abuse, and such.
If they made it too simple, someone is bound to do something and say "but you never said so."
The bright idea came from the consumers, imo. :D

Edit: Maybe 'dirt' may be that strong of a word. But I suppose for some people,
