  how many times can the 1st dan test be taken if you fail ?

  The first question isn't answered but it should be common sense. /(rhetorical question) Is there any reason the advancement NPCs would restrict you from applying if your Dan experience can drop after 4 weeks (the rank won't drop just experience gained from the tests)?
  
  I personally think that the Dan titles (except life skill titles) are a poor investment.
  
  Second question: No, go read about why in the links.
  *correction, a higher rank can do a lower rank. Fail to your content. Succeeding the test will give the high dan half the experience than they would have gotten. Failing it should have no draw back aside from the application fee, but read the wiki page cause I am lazy.

  You can only take one of each type a day, iirc.
  i.e.: 1 Combat, 1 Life and 1 Magic Test are allowed per day the tests are being run.

  You need to mod the client to turn it off i think.

  It affects both trans and missile magic cutscene, as well as full swing.
  You go to options, and try to find the check box that says "skip all transformation cutscenes" then uncheck it.

  "A small cutscene plays when the skill is used. This can be turned off in the game's "Options" menu. Simply uncheck "Skill Cam". "
  
  So basically you checked [Use Skill Cam] at some point. Uncheck it and that little cutscene will go away.
  
  It's on the bottom of this page in the in-game options if you're having trouble finding it:
