You'll give them your money and they'll get shut down by Nintendo. And then the creator will buy a nice new car.

The moment donations start opening up, Nintendo will argue that it is for profit because the creators have expressed interest in public donations.

Nintendo Is Vicious. (Especially when it comes to pokemon), and Nintendo NA has shut down many many MANY sites before with pokemon names and pokemon references in the early days.

Not true.

They've gone after plenty of non-profit projects that got too much attention.

Super Mario X comes to mind.

I almost don't blame them though. This game is/was better than any other official mario game. I played it with my sister for weeks.

There have been lots of other fan projects that use nintendo's IP that nintendo is quick to C&D.

It really just depends entirely on whether the IP owners want to pursue against it or not. Their location is also quite important.

Basically I'm saying you should be really cautious about giving your money to a project that can be shut down on a whim. A cease and desist literally can be applied anywhere IP infringement occurs, regardless of whether it makes money or not.
