That doesn't mean what I'm saying is wrong. As intellectual property owners, Nintendo and Gamefreak can shut down any project that breaches said property, regardless of whether it is profit or not.
They are notorious for having done so in the past, but that doesn't mean every project gets shut down. Take for example, the pokedex app on android. It was a free app that Nintendo shut down because it would be in direct competition with their 3DS pokedex app.
So I'm just warning everyone to support/donate the guy in the OP's link at your own discretion. These donation funding programs don't have an enforced money return function once the money has been fully sent, so if he gets shut down by Nintendo, you're not going to be seeing your money or your game.

In some cases, they will even allow people to make profit, but it's also up to them if they don't want certain fan works being distributed. I don't know if it applies to ripped game art, though, since that's usually illegal(?).

I've never had any problem selling Nintendo-based fan works myself. I have gotten a Minecraft-based fan work taken down, though.
I know Nintendo will not allow it if it has any "adult" content, as they have a strong "family friendly" policy.
As for Pokemon, well I have played a Pokemon MMO before, and it seems to still be up for quite a while, so I don't really know how they handle Pokemon fan-games using original game sprites. It also makes it hard to figure out since you're required to have the original game files on your computer to play it, and they don't provide the ROM files.
PS: That game looks well-made. I like that they actually have textures for things such as the landscape, and the faces are shaped like the anime. I think I would rather enjoy while it's up, than never.

I love that you control the Pokemon and can run around and stuff while fighting. Also really like that withdrawing the Pokemon makes the Pokeball shoot the beam like in that anime.

Yeah it looks like fun if it's not old-fashioned turn based. :D It's really the best of both worlds(anime and game).

I wish nintendo would be more liberal with pokemon, literally ANYTHING they do with the series will make them money at this point so I don't see why not. I think the closest thing to this that has actually come out is pokemon rumble but that's only for the 3DS so not everyone can play it.

Yeah, I'd love a full 3D pokemon RPG(turn-based or real time) game for once. I mean I know there was one for the GameCube long ago, but it wasn't very extensive.
They could pretty much use Pokemon Stadiums as the basis for battle system if they wanted, and just make a world where we can run around and follow a storyline like the gameboy/ds/3ds games.
Though I think the turn-based system is what's making me lose interest in the Pokemon game series... I know it's "classic" and all that, but I just don't have the patience or time for grinding anymore.

Well I think pokemon X/Y will be that full 3D experience everyones been waiting for. Also for the core games the turn-based system is wonderful, it's become pretty in-depth and the OU metagame is really really fun and addictive if you get into it. Nothing like beating someone with a team that you've spent countless hours working on. Unless you use pokemon online, then you've thrown the fun part out the window (the grinding aspect) and you get bored really quick.
