If someone's willing to work for that little of money, great. However, such a thing would be illegal, as there's a minimum wage. It shouldn't be accepted as a social (or legal) norm that tips can compensate for that and bring them up to minimum wage. Tips should be an act of kindness when someone goes above and beyond what they're expected to do at their job rather than just getting it over with and not being jerks.

you do know that in some states minimum wage does not apply to waitress/waiter positions
and it's perfectly legal

It's my understanding that the reason it doesn't apply is because they're expected to make up for it in tips. This suggests that the law needs changing, because things really aren't supposed to work that way. What if we just started paying people whatever we felt like? It would be a disaster filled with nonstop complaints and issues.

my point is that if they're being paid less than minimum wage and they're legally working, then it's not illegal where they are - since you said

I'm pretty sure tips have to equalize it. If they don't, I don't know what happens. In any case, if it was inconsistent enough, I believe it wouldn't be allowed. This is just what I've heard from a few people I spoke to many years ago. It isn't from a valid source.
Anyway, the laws should be changed regardless.

I'm just going to skip a bunch of pages and respond, since I see a lot of replies are borderline insulting towards myself and those that agreed with me:
What I'm saying is that the practice of expected/required tipping is bullshit. It makes it not even a tip and at that point you may as well just tab it onto the bill if it's really required.
And what else, that I haven't said (but I believe), is that their making a big deal out of this guy writing "get a real job" on the bill, well that's just plain fucking stupid, and I'll tell you why: They're making it into a 1% vs 99% drama filled outrage bullshit. So what if the guy's a banker? Do you guys really think bankers make a lot of money? Unless he's higher up on the chain, bankers make about the same as any other job (barring the cost of the meal, which I'll just give a reasonable doubt that perhaps he really was doing quite well in his position, though I've been in places where the damn wine is more expensive than their entire meal - which was for multiple people).
What I'm getting at is, who gives a shit if he was a banker? What if he was some redneck from a trailer park that worked as a union contractor of some sort? Would there still be such an outrage? So what if the guy's an asshole? You want to classify an entire group of people because one guy was a prick?
I hate to tell you this, but there are a lot of pricks in the world. How much money you make isn't even part of it.
And I know you all just want to give the waiter the reason of the doubt, but honestly... Maybe the waiter sucked shitballs and was a horrible waiter and that's why he left a nasty note. It was obviously an expensive restaurant and if your service wasn't up to par, and was really that bad, then maybe you should find a different job (especially if you're having to serve assholes like this).
What gets me, is that it wasn't even anyone at the restaurant that made this shit public. It was one of his dining companions. Obviously they have some kind of problem with the guy, either jealousy or something else, and chances are that the whole thing was blown out of proportion just to make the guy look bad in the first place, not to mention how shitty of a person you have to be to go out and eat with someone and do something like that to them simultaneously. That's a smile on the outside and an "I fucking hate you" on the inside. Honestly, I'd say the dining companion that felt the need to dine with this person they obviously despise and go on to slander them on a blog later about how horrible of a person they are - they're the ones that should find a new job.
P.S. $140 bill for 2 people, that's only $70 each. That's not exactly all that bad. And if it's 3 people, that's even less severe. I mean $46 each? That's pretty expected in most restaurants... I just think this whole thing is stupid, especially how it's becoming some social class outrage rather than what it is: One prick on his onesies being an asshole to someone.

it's not the responsibility of the customer to bring that wage up to the minimum, it's the employer's
still, the minimum wage for waitresses and waiters is less than the regular minimum allowed in some states, the employer only has to make up the rest and bring it up to the usual minimum if they don't earn enough in tips for that hour
the customer is never really
obligated to leave a tip, but that doesn't mean that you won't be considered rude if you leave a 1% tip or don't tip at all (assuming service was decent) since, after all, that
is the social norm

UPDATE: According to The Smoking Gun, the restaurant says they found the original merchant copy, and the receipt going around the Web is Photoshopped. We are waiting to hear back from the restaurant for confirmation.

If anyone, from any walk of life, did what he was purported to do, I would take exception to it. The whole 99% vs. 1% thing didn't come into play for me...working in both restaurants and retail has taught me that one doesn't need money to be a jerk.
Also, since it was said to be someone from his party, the suggestion is that not everyone was as dissatisfied with the service and thus it was not the waitress' fault.
I wonder why someone would fake it though...and why this didn't come out when the initial site went down.
